As an international student, worker, or visitor in Canada, it is essential to maintain your temporary status throughout your stay. However, sometimes you may inadvertently lose your status due to unforeseen circumstances, such as failing to apply for an extension of your status before it expires or having your application for an extension denied. In such cases, you may still have the option to restore your status in Canada.

Restoring your status means that you can continue to live, work, or study in Canada under your original authorization. However, it''s important to note that you can only restore your status to what you held before it expired. You cannot change your permit until you restore your status and original authorization. After restoration, if you're eligible, you may be able to apply for a different permit.

You must apply within 90 days of the expiration of your status document or within 90 days of receiving the refusal of your application for an extension of your status.
You must have met the initial requirements of your stay in Canada and must have complied with all the conditions of your permit.

You must demonstrate that you are a genuine temporary resident who will leave Canada at the end of your stay.
You must continue to meet the requirements of a temporary resident and the requirements of your work or study permit, as applicable.

Process for Restoring Your Status

The process for restoring your status in Canada is outlined by Immigration, Refugees, and Citizenship Canada (IRCC) and involves the following steps:

Determine your eligibility: Review the eligibility criteria for restoring your status to ensure that you meet all the requirements.
Gather your documents: Collect all the required documents, including a valid passport, a copy of your current immigration document (visit, work, or study permit), and evidence of financial means to support your extended stay in Canada.
Apply for restoration of your status: You can apply for restoration of your status online or on paper, depending on your eligibility. You should submit your application as soon as possible after losing your status, but no later than 90 days after losing it.
Wait for a decision: After you submit your application, you must wait for a decision from the IRCC. You must remain in Canada until a decision is made on your application.

It is important to note that restoring your status does not guarantee approval of your application. The IRCC will consider several factors, including your compliance with the conditions of your permit, your intention to leave Canada at the end of your stay, and your ability to meet the requirements of a temporary resident. If your restoration application is approved, you can continue to live, work, or study in Canada under your original authorization. However, if your application is refused, you must leave Canada immediately.
